Any additional freight, redelivery, return-to-sender or handling costs incurred as a result of incorrect delivery details will be the responsibility of the customer.

Returns and Refunds

• Satisfaction Guarantee: We offer a money-back guarantee on specific products. If unsatisfied, please contact us for a return authorization.
• Return Conditions: Products must be returned in new condition, in original packaging. Return shipping costs are the customer’s responsibility, except for products that are DOA (Dead on Arrival) or damaged items.

1. Introduction

Hello — these Terms and Conditions (Terms) govern your use of Pestrol Pat, an AI-powered assistant (Pat) provided by Lifestyle Logic Pty Ltd ACN 102 450 493 (ABN 77 102 450 493) trading as Pestrol (Pestrol, we, us, our). In these Terms, references to Pestrol Pat and Pat mean the same thing.

In these Terms, you means the person accessing or using Pestrol Pat. Any reference to you is also a reference to an Eligible User as defined in clause 2.

Please read these Terms carefully, together with our Privacy Policy. These Terms explain our obligations and your obligations when using Pestrol Pat.

2. Eligibility and Acceptance

Pestrol Pat is available on the Pestrol website to users who provide their name and email address (Eligible Users).

2.1 How you accept these Terms

Before you begin chatting with Pat, you will be asked to enter your name and email address. A notice next to the submit button will inform you that by chatting you agree to these Terms and our Privacy Policy, with links to both.

By entering your name and email address and submitting the form to begin chatting with Pat, you accept these Terms and our Privacy Policy. If you do not accept these Terms, you must not submit the form or use Pat.

2.2 Re-confirmation after 24 hours

For your protection and ours, your acceptance of these Terms is only effective for a 24-hour period following submission. After 24 hours, you will be prompted to re-enter your name and email address to continue using Pat. This ensures the person chatting with Pat is the person who has accepted these Terms, and that you are seeing the current version of these Terms each day you use the service.

Because these Terms may be updated from time to time, the version of these Terms in force at the time you submit your name and email is the version that applies to your use of Pat until your next re-confirmation. Updates are published on our website, and because you re-confirm acceptance at least every 24 hours of active use, you will be bound by the current version each time you resume using Pat.

2.3 Age requirements

Pat is intended for use by persons aged 18 years or over. If you are between 13 and 17 years old, you may only use Pat with the consent and supervision of a parent or legal guardian, who accepts these Terms on your behalf and assumes responsibility for your use of Pat. Pat is not directed at, and must not be used by, children under 13.

By submitting the form to use Pat, you confirm that you are 18 years or over, or that you are 13–17 years of age and using Pat with parental consent and supervision.

2.4 Use is voluntary

Your use of Pat is voluntary. You will not be paid a fee or incentive for interacting with Pat, and you will not be reimbursed for money spent in response to any information Pat provides.

2.5 Accuracy of the details you provide

You must provide a genuine name and a valid email address you control. You must not provide another person’s details or use Pat on behalf of someone else without their consent.

3. Nature of the Service

Pestrol Pat is an automated conversational system powered by artificial intelligence and large language model technology. Pestrol Pat is designed to help Eligible Users navigate the Pestrol website, locate products, check availability, and obtain general information about pest control and home and garden topics (the Permitted Purpose).

Although Pestrol Pat has a human-sounding name, Pat is not a person. Pat is an AI assistant. Sometimes Pat’s responses may seem like they are coming from a Pestrol team member, but all responses are generated by AI and are not reviewed by a human before being shown to you. You are not speaking with a Pestrol employee, contractor, or licensed pest control professional at any time when interacting with Pat.

You acknowledge and agree that:

• information may be incomplete, out of date, inaccurate, or unsuitable for your circumstances;
• Pestrol Pat does not provide professional, technical, legal, medical, veterinary, or regulated advice;
• Pestrol Pat does not and cannot inspect your property, assess your specific situation, or diagnose an infestation;
• Pestrol Pat is not a licensed pest control provider and does not replace one;
• Pestrol Pat is an evolving system and its capabilities, behaviour, and availability may change without notice.

Pestrol Pat is provided for general informational and navigational purposes only.

4. Permitted Use

We grant you a non-exclusive, non-transferable, limited, and revocable licence to use Pestrol Pat for the Permitted Purpose.

4.1 You must not:

• permit another person to use Pat under the name and email address you have submitted;
• use Pestrol Pat for any unlawful, fraudulent, harmful, harassing, defamatory, discriminatory, obscene, or misleading purpose;
• copy, modify, reverse engineer, decompile, or attempt to extract the model weights, prompts, or source code of Pestrol Pat or its underlying systems;
• attempt to circumvent, disable, or manipulate Pestrol Pat’s safety controls, content filters, or instructions (including through prompt injection, jailbreaking, or similar techniques);
• introduce any virus, worm, malware, or malicious code to Pestrol Pat;
• use Pestrol Pat to develop a competing product, to train another AI system, or to scrape or harvest responses at scale;
• use Pestrol Pat in any way that could damage, disable, overburden, or impair our systems or interfere with any other user’s use of Pestrol Pat;
• rely on Pestrol Pat for professional, technical, safety-critical, or regulated decisions;
• submit any prompt or data on behalf of a third party without their consent.

You are responsible for all prompts, messages, and other data you submit to Pestrol Pat (Inputs), and you must ensure your Inputs do not breach any applicable law or these Terms.

We may monitor, restrict, suspend, or terminate your use of Pestrol Pat at any time at our discretion, including where we reasonably believe these Terms have been breached.

5. No Professional Advice

Pestrol Pat does not provide professional pest control, chemical handling, veterinary, medical, safety, environmental, legal, or regulatory advice.

You must seek advice from a qualified professional (such as a licensed pest control operator, veterinarian, medical practitioner, or regulator) where your situation requires it — including, without limitation, where:

• the infestation involves termites, bed bugs, or other species requiring specialist treatment;
• children, pregnant women, elderly persons, pets, livestock, or food-producing areas may be exposed to a product;
• a person or animal has been exposed to, ingested, or had an adverse reaction to a product (in which case contact the Poisons Information Centre on 13 11 26 (Australia), a veterinarian, or emergency services immediately);
• you are unsure whether a product is suitable, safe, or lawful for your intended use;
• restricted, prohibited, or regulated chemicals are involved.

6. Product Use, Chemical Safety, and Label Supremacy

This section is critical. Please read it carefully.

All products sold by Pestrol (including rodenticides, insecticides, herbicides, fungicides, and other chemical products) must be used strictly in accordance with:

• the product label and any accompanying Safety Data Sheet (SDS);
• all applicable Australian laws and regulations, including the Agricultural and Veterinary Chemicals Code Act 1994 (Cth) and APVMA requirements;
• any State or Territory laws governing the storage, handling, use, and disposal of chemical products.

You are solely responsible for:

• reading and understanding the product label and SDS before use;
• ensuring the product is suitable for your intended purpose;
• using appropriate personal protective equipment;
• protecting humans, pets, wildlife, food, food-contact surfaces, water sources, and the environment from exposure;
• the safe storage, application, and disposal of products and containers.

6.1 Label Supremacy Clause

If there is any inconsistency, ambiguity, or apparent conflict between information provided by Pestrol Pat and the product label, SDS, packaging, or official instructions, you MUST follow the product label and official instructions. The label prevails at all times.

6.2 Pestrol Pat does not provide

Without limiting clause 5, Pestrol Pat does not provide, and you must not rely on Pestrol Pat for:

• specific dosing, dilution, mixing ratios, or application rates;
• advice on whether a product is safe to use around specific pets, children, pregnant women, or particular species;
• re-entry intervals, withholding periods, or harvest intervals;
• advice on combining, mixing, or substituting chemical products;
• emergency first-aid or poisoning response advice.

For all such information, you must consult the product label, SDS, a licensed professional, or the Poisons Information Centre (13 11 26 in Australia).

6.3 Pricing information

Any pricing information provided by Pestrol Pat does not constitute an offer or quote. For accurate and up-to-date pricing, consult the Pestrol website or contact us directly.

6.4 Product information

Product information provided by Pestrol Pat regarding suitability, capability, availability, and terms of use may be inaccurate or incomplete and does not constitute advice from Pestrol. Please verify product information through the Pestrol website or by consulting a qualified professional.

7. No Guarantee of Results

Pest control outcomes depend on many factors outside our control, including infestation type and size, environmental conditions, property characteristics, application technique, and user behaviour.

To the maximum extent permitted by law, Pestrol does not warrant or guarantee any particular outcome, result, or level of effectiveness from following Pestrol Pat’s guidance or from the use of any product referenced by Pestrol Pat.

8. Your Responsibility

You are solely responsible for:

• evaluating the suitability, accuracy, and safety of any information provided by Pestrol Pat;
• independently verifying information before acting on it;
• ensuring your use of any product or technique is safe, lawful, and appropriate to your circumstances;
• all decisions you make and actions you take based on Pestrol Pat’s output.

Any reliance you place on Pestrol Pat is entirely at your own risk.

9. Your Inputs, Data, and Privacy

9.1 Your Inputs

You are responsible for any information you submit to Pestrol Pat (Inputs). You should not submit:

• sensitive personal information (including health, biometric, racial, religious, sexual orientation, or criminal record information);
• government identifiers (such as Tax File Numbers, Medicare numbers, or driver licence numbers);
• payment card details, passwords, or account credentials;
• confidential, proprietary, or third-party information you are not authorised to share;
• content that is unlawful, defamatory, infringing, or otherwise objectionable.

If you submit such information, you do so at your own risk and accept full responsibility for that disclosure.

9.2 Identification

Because you provide your name and email address before using Pat, your interactions with Pat are linked to those details, together with your IP address and session information. Your conversations with Pat are not anonymous to us.

9.3 How we use your Inputs and conversation data

We collect and use your Inputs, conversation transcripts, and related metadata (such as timestamps, session, and device information) to:

• operate Pestrol Pat and generate responses to you;
• provide customer support and respond to your enquiries;
• analyse performance, identify issues, and improve Pestrol Pat’s accuracy, safety, knowledge base, prompts, and content;
• train and fine-tune AI tools we use to support Pestrol’s customers (see clause 9.4);
• detect and prevent misuse, fraud, and security incidents;
• comply with our legal obligations and enforce these Terms;
• produce de-identified analytics and aggregated insights.

We do not sell your personal information. We do not share your conversations with third parties for their own marketing or AI training.

9.4 Use of conversations to improve our AI

We use conversations with Pestrol Pat to fine-tune AI tools we use to support our customers. Before conversations are used for fine-tuning, we take steps to de-identify the data — removing information such as names, email addresses, phone numbers, and addresses — so the fine-tuning dataset does not contain information that identifies you.

If you would prefer your conversations not be used for fine-tuning, you can opt out at any time by emailing [email protected]. Opting out does not affect your ability to use Pestrol Pat. Opt-out requests apply to future conversations and, where practicable, to conversations still within the 30-day retention period referred to in clause 9.6.

9.5 Third-party AI providers

Pestrol Pat is powered by third-party AI and infrastructure providers, which may be located outside Australia (including in the United States and other jurisdictions). Your Inputs may be processed by these providers solely to generate responses to you. Under our contractual arrangements with these providers, your Inputs are not used to train their models.

By using Pestrol Pat, you consent to this cross-border processing for the purposes described in these Terms and in our Privacy Policy. Before disclosing your personal information to an overseas recipient, we take steps that are reasonable in the circumstances having regard to Australian Privacy Principle 8.

9.6 Retention and deletion

We retain data as follows:

• raw conversation transcripts and chat-window data: deleted approximately 30 days after the conversation;
• insights logs, system logs, and security records: retained for up to 180 days, or longer where required by law or for fraud prevention and dispute resolution;
• de-identified conversation data used for fine-tuning: retained on an ongoing basis as it no longer identifies you.

While raw conversations remain within the retention period, they may be accessed by Pestrol for the purposes described in clause 9.3, including by a customer’s request to access their chat history.

9.7 Your rights

You may request access to, correction of, or deletion of your personal information by contacting us using the details in clause 18, or as described in our Privacy Policy. You may also opt out of fine-tuning use as set out in clause 9.4.

9.8 Privacy Policy governs

Our collection, use, storage, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference and is available at https://www.pestrol.com.au/privacy-policy/. In the event of any inconsistency between these Terms and our Privacy Policy in respect of personal information, the Privacy Policy prevails.

10. AI Limitations and Disclaimers

You expressly acknowledge that Pestrol Pat, like all AI systems:

• may generate information that is incorrect, outdated, incomplete, biased, or misleading (including so-called “hallucinations”);
• may misunderstand your query, context, or intent;
• may produce responses that are inconsistent between sessions;
• may reference products, services, or regulations that have changed, been withdrawn, or are no longer applicable;
• may produce content that does not reflect Pestrol’s views or values;
• does not have real-time access to your order, account, inventory, or transaction data unless expressly integrated.

You must exercise independent judgement and verify any information from Pestrol Pat before relying on it.

11. Intellectual Property

All intellectual property rights in Pestrol Pat, including its underlying software, interface, branding, and content provided by Pestrol, are owned by or licensed to Pestrol and its licensors. These Terms do not transfer any such rights to you.

You retain ownership of your Inputs. By submitting Inputs, you grant Pestrol a worldwide, royalty-free licence to use, store, process, reproduce, and create derivative works from those Inputs for the purposes described in clause 9.3 and for the internal operation and improvement of Pestrol’s products and services.

Pestrol Pat’s outputs are generated by AI and may not be unique to you. Pestrol makes no warranty as to the originality or non-infringement of any output, and to the extent we hold any rights in outputs that are capable of being licensed, we grant you a non-exclusive licence to use outputs for your personal or internal business purposes, subject to these Terms.

11.1 Feedback

If you provide feedback, suggestions, comments, or recommendations about Pestrol Pat (Feedback), we are free to use, reproduce, license, and exploit that Feedback (including to improve Pestrol Pat) without any obligation to you. You assign to us all intellectual property rights, if any, in the Feedback.

12. Third-Party Content and Links

Pestrol Pat may reference or link to third-party products, websites, or content. Pestrol does not control, endorse, or assume any responsibility for third-party content. Your access to and use of third-party content is at your own risk and subject to the relevant third party’s terms.

13. Consumer Rights and Liability

13.1 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded, restricted, or modified.

If you are a “consumer” as defined in the Australian Consumer Law, you have statutory rights and guarantees in relation to goods and services supplied to you that operate in addition to these Terms.

13.2 Limitation of liability

Subject to clause 13.1, and to the maximum extent permitted by law:

• Pestrol Pat is provided on an “as is” basis. Pestrol excludes all conditions, warranties, representations, and terms (whether express, implied, statutory, or otherwise) in relation to Pestrol Pat, other than those that cannot be excluded;
• Pestrol is not liable to you or any third party for any indirect, consequential, special, incidental, punitive, or exemplary loss or damage, or for any loss of profits, revenue, business, goodwill, data, opportunity, or anticipated savings, however arising (including in contract, tort (including negligence), statute, or otherwise);

Where Pestrol’s liability for a breach of a consumer guarantee under the Australian Consumer Law can be limited, our liability is limited, at our option, to the re-supply of the relevant services or the payment of the cost of having the services supplied again.

13.3 Release

To the maximum extent permitted by law, you release Pestrol from all claims, losses, damages, liabilities, costs, and expenses arising out of or in connection with:

• your use of, or reliance on, Pestrol Pat or its outputs;
• your use, misuse, storage, handling, or disposal of any product;
• your breach of these Terms; and
• any act or omission of a third party.

14. Indemnity

To the maximum extent permitted by law, you indemnify and hold harmless Pestrol, its related bodies corporate, and their directors, officers, employees, and agents from and against all claims, liabilities, losses, damages, costs, and expenses (including legal costs on a full indemnity basis) arising out of or in connection with:

• your breach of these Terms;
• your violation of any law or the rights of a third party (including intellectual property and privacy rights);
• your misuse of any product;
• any Input you submit or any content you upload;
• any claim by a third party on whose behalf you have used Pestrol Pat.

This clause does not apply to the extent the relevant loss or damage is caused by Pestrol’s fraud, wilful misconduct, or gross negligence.

15. Availability, Changes, and Force Majeure

We may at any time, without notice and without liability to you:

• modify, suspend, or discontinue Pestrol Pat (in whole or in part);
• change Pestrol Pat’s features, scope, or underlying technology (including AI providers);
• restrict, suspend, or revoke your access;
• update these Terms by posting a revised version on our website.

Because you re-confirm acceptance at least every 24 hours of active use (see clause 2.2), each time you enter your name and email to resume using Pat, you accept the version of these Terms then in force. Your continued use of Pat after changes take effect constitutes acceptance of the updated Terms.

Pestrol is not liable for any delay, interruption, or failure to perform caused by any event beyond our reasonable control, including acts of God, natural disasters, pandemics, war, civil unrest, labour disputes, internet or telecommunications outages, cyber-attacks, or failures, changes, or withdrawals of third-party AI, cloud, or infrastructure services.

16. Termination

We may suspend or terminate your access to Pestrol Pat at any time, with or without notice, at our discretion — including where we reasonably believe you have breached these Terms.

Upon termination:

• your right to access and use Pestrol Pat ceases immediately;
• clauses that by their nature are intended to survive termination will survive, including clauses 9 (Data), 11 (IP), 13 (Liability), 14 (Indemnity), 17 (General), and 19 (Governing Law);
• we will handle your personal information in accordance with our Privacy Policy, including any retention and deletion requirements.

17. General Provisions

17.1 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be severed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

17.2 No waiver

A failure or delay by Pestrol to exercise any right under these Terms does not operate as a waiver of that right.

17.3 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign or novate our rights and obligations under these Terms to any related body corporate or to a purchaser of our business.

17.4 Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pestrol in relation to Pestrol Pat and supersede all prior understandings or agreements on that subject matter.

17.5 Records as evidence

You agree that our records of your interactions with Pestrol Pat (including chat logs, timestamps, and acceptance records) are admissible as evidence in any proceedings and are conclusive evidence of the matters recorded, absent manifest error.

17.6 Relationship

Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Pestrol.

We aim to acknowledge complaints within 5 business days and resolve them within a reasonable time. 19. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. You and Pestrol submit to the exclusive jurisdiction of the courts of New South Wales and the courts competent to hear appeals from them.
